Patna High Court CWJC No.16122 of 2014 (4) dt.20-08-2018 2/2 20-08-2018 It is submitted by Mr. S.B.K. Mangalam, learned counsel for the petitioner that though intimation regarding the order dated 22.12.2015 passed by this Court was sent to the petitioner, she did not turn up as a result of which the order was not complied with.
Be that as it may, since the order dated 22.12.2015 was not complied with within the time granted by the Court, the writ petition stood dismissed as against respondent nos. 5 to 16 on 08.01.2016. In absence of respondent nos. 5 to 16, the writ petition cannot proceed. Moreover, since the dispute raised in the writ petition relates to an election, which was held in the year 2011, and the term has already expired whereafter even a fresh election has taken place for the post of Mukhiya of Gram Panchayat, Barhauna, under Kako Block in the district of Jehanabad, the writ petition has virtually become infructuous. Accordingly, it is dismissed as infructuous.
