The petitioner seeks regular bail in Bela P.S. Case No. 27 of 2014 for the offence under Sections 395 and 412 of the Indian Penal Code.
Sunil Kumar Chaudhary, the informant, alleged that different articles were looted away. An F.I.R. was lodged against unknown.
Learned counsel for the petitioner submits that the petitioner was apprehended and from his possession, one motorcycle was recovered. The recovered motorcycle is not a stolen one. Except the so-called confessional statement of the petitioner, no tangible material has been collected. The petitioner was not put on T.I.P. and the petitioner is in jail since 25.10.2014.
Patna High Court Cr.Misc. No.4552 of 2015 (2) dt.03-02-2015 2/2 Learned A.P.P. has submitted that a motorcycle was recovered from the possession of the petitioner. On a consideration of the facts, it appears that the petitioner is not named in the F.I.R., the motorcycle, which was recovered from the possession of the petitioner, is not a looted article and the petitioner has not been put on T.I.P. as yet. Considering the fact aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Bela P.S.
