JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-01-2015 Heard learned counsel for the petitioners and the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 461, 379, 411 of the Indian Penal Code.
It is alleged that the pumping set of the informant was stolen. Subsequently, the mark of the wheel is found from the boring to the door of petitioner no. 2 Mazid Mian. Though the pumping set was recovered from the fodder house of petitioner no. 1 namely Rahim Mian.
Considering the fact that recovery has been made from the house of petitioner no. 1, this Court is not inclined to grant anticipatory bail to the above named petitioner no. 1.
Patna High Court Cr.Misc. No.3630 of 2015 (2) dt.28-01-2015 Accordingly, his prayer for anticipatory bail is rejected. Considering the suspicious nature of accusation against petitioner no. 2 having no criminal antecedent, let the above named petitioner no. 2 be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatia P.S. Case No. 187 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
