The petitioner seeks bail in Fatuah P.S. Case No. 39 of 2021, registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

It is a case of dowry death. Petitioner is father-in-law of the deceased.

It is submitted on behalf of the petitioner that thrust of accusation is against husband of the deceased who is already in custody. No specific overt act has been attributed against this petitioner and he is living separately and has got no concern with the family affairs of the deceased and her husband. Petitioner is in custody since 09.09.2021 having no criminal antecedent. Investigation is complete.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.72176 of 2021(2) dt.10-03-2022 2/2 and the fact that petitioner is father-in-law of the deceased and there is general and omnibus allegation, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Patna City in connection with Fatuah P.S. Case No. 39 of 2021.
