JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-11-2018 A supplementary show cause on behalf of the Opposite Parties Tilka Manjhi Bhagalpur University is available on the record. Learned counsel representing the University has placed before this Court the statements made in Paragraph Nos. 3 to 6. It is submitted on behalf of the University that the various claims of the petitioner have been examined and the admitted claims have already been paid. As regards the payment in revised scale w.e.f. 01.01.2006, it is stated that the claim for the period
Patna High Court MJC No.3727 of 2014 (14) dt.19-11-2018 2/2 April, 2010 to May, 2010 have also been examined and since the revised scale came into force from April, 2010 after receipt of the grant of the State Government, hence, there is no question of arrear or difference of arrears of salary for the aforesaid period. Regarding two entitlements of two additional increments in view of having obtained Ph.D. degree, it is stated that the petitioner is not entitled to get the benefits of two increments. Reasons in this regard have been shown in Paragraph-8 of the show cause. In the given facts and circumstance, learned counsel for the petitioner submits that instead of pressing this contempt application he would request this Court to allow him to agitate his grievance with respect to denied claims by filing appropriate representation before the Registrar of the University within a period of 30 days from today.
This application is disposed off with the liberty aforesaid.
If such representation is filed, the Registrar of the University shall look into the matter and shall communicate the same to the petitioner with his decision in that regard. (Rajeev Ranjan Prasad, J) R.R.Ojha/Ved/- U
