The petitioner apprehends her arrest in a case registered for offences punishable under Sections 341, 323 and 302/34 of the Indian Penal Code.
As per allegation set out in the first information report co-accused Fanoj Mandal and petitioner only caught hold of Rajpati Mandal. The deceased was assaulted by co-accused Vijay Mandal due to which he became unconscious and during treatment he died.
It is urged that specific allegation of assault is upon the aforesaid Vijay Mandal and petitioner is a lady having clean antecedent.
Patna High Court Cr.Misc. No.16017 of 2016 (2) dt.23-05-2016 2/2 Having regard to the facts and circumstances, and the fact that the petitioner is a lady, this court would be inclined to grant privilege of anticipatory bail to her and accordingly let petitioner Lalita Devi be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Tikapatti P.S. Case No. 126 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
