JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-08-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in Narhat P.S. Case No.158 of 2016 registered for the offences under Sections 341, 323, 307, 504, 337, 338 and 324/34 of the I.P.C. Accusation is that due to land dispute the occurrence of Mar Pit took place in between the petitioners and the informant in which petitioner no.1Myurdhwaj Singh gave a garasa blow causing injury at the nose of Praveen Singh, uncle of the informant. Petitioner no.2 Purushotam Kumar gave sword blow causing injury on the head of Ajay Singh who also became senseless.

No.9120 of 2017 (10) dt.07-08-2017 2/2 Learned counsel appearing on behalf of the petitioners submits that, in fact, the occurrence of mar pit took place due to land dispute in which both petitioners and others also sustained injuries for which Narhat P.S.Case No.162/16 was instituted under Section 341, 323, 307, 504,338/34 of the I.P.C. Moreover, three injuries were found on the person of Praveen Singh out of which two are simple and one is said to be grievous. Whereas the injuries found on the person of Ajay Singh are said to be simple in nature.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M.- III, Nawada, in Narhat P.S.Case No.158/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
