The petitioner seeks pre-arrest bail in connection with Tarapur P.S. Case No. 4 of 2018 (G.R. No. 38 of 2018) for the offences alleged under Sections 341, 323, 504, 376, 511 and 448 of the Indian Penal Code.

The accusation is that at about 09.00 p.m. on 21.12.2017, informant was at cot in her house, along with her children, at that time, the petitioner entered in her house and started to outrage her modesty. When she made protest, she was abused and her blouse was also torn. When she and her children raised alarm, then, seeing the neighbour coming there, the petitioner fled away from there.

The submission of the learned counsel for the petitioner is that while the occurrence is said to be of

Patna High Court CR. MISC. No.59976 of 2019(2) dt.23-09-2019 2/2 21.12.2017, but, present case has been lodged after 12 days of the occurrence. In fact, due to dirty village politics, the informant lodged the present case with false allegation against the petitioner. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Tarapur P.S. Case No. 4 of 2018 (G.R. No. 38 of 2018) shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Gautam Kumar, Judicial Magistrate, 1st Class, Munger, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
