JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

The house of the petitioner was raided when suspected stolen motorcycle was recovered and brother of the petitioner Santosh Sharma was apprehended who disclosed the name of the petitioner as the person who escaped from the scene. It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house and nothing has been recovered from the possession of the petitioner. The brother of the informant has been granted anticipatory bail by the learned court below itself. Though, the petitioner had no criminal antecedent prior to the lodging of the present case but subsequent

Patna High Court Cr.Misc. No.15050 of 2016 (2) dt.11-04-2016 2/2 to present case, the petitioner has been roped in one other case also.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Morhowrah P.S. Case No. 70 of 2016 pending in the court of learned ACJM-II, Chapra, Saran. Accordingly, the application is disposed of.
