====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in N.D.P.S. Case No. 48 of 2018 arising out of Chakia P.S. Case No. 207 of 2018 instituted for the offence under Sections 414, 120B of the Indian Penal Code, Section 25(1-b), 26, 35 of Arms Act, Sections 20 and 22 of Narcotic Drugs and Psychotropic Substances Act (N.D.P.S. Act.) Counsel for the petitioner submits that there is no recovery of any incriminating article from possession of the petitioner. Co-accused Arun Kumar has been granted bail by this Court vide order dated 7.12.2018 passed in Cr. Misc. 73222 of 2018.

Patna High Court Cr.Misc. No.76218 of 2018(2) dt.18-12-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Motihari, East Champaran, in connection with N.D.P.S.
