JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 Petitioners apprehend their arrest in connection with Nabinagar P.S. Case No. 53 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354, 435, 353, 332, 333, 379, 427, 504 and 120B of the Indian Penal Code.

Allegation as per FIR is that a child met with an accident by truck and for that father of the child has lodged a case and thereafter police has lodged another case and later on owner of the vehicle has lodged a case, which is the present one against 200 persons that they assaulted driver of the truck and no specific allegation has been made against any of the

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S. Case No. 53 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
