Petitioner apprehends arrest in connection with Barhara P.S. Case No. 293 of 2022 registered for the offence under sections 498A, 504, 506/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report. As a matter of fact, the petitioner had earlier filed a divorce case vide Matrimonial Case No. 13 of 2022 on 14.03.2022 and in retaliation to the same the opposite party no. 2 has lodged the present first information report. Patna High Court CR. MISC. No.59749 of 2022(3) dt.24-02-2023 2/2 present first information report has been lodged after 7 days of the alleged occurrence without there being any plausible explanation for the delay. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistate II, Purnea in connection with Barhara P.S.
