Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 420, 467, 468 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that in purchase of medicine for the financial year 201415, financial irregularity was committed in breach of departmental guidelines, the suppliers of the medicine withdrew an amount of Rs. 4,50,70,354/- from the treasury through fully vouched bills, but when store was inspected, it was found that medicine worth Rs. 85,07,920/- was passed, accordingly a

No.65298 of 2024(3) dt.24-01-2025 2/3 committee was constituted to identify the accused persons involved in the occurrence and the committee, after inquiry, recommended to initiate action against Dr. Meera Verma, Dr. U.S. Pathak, Bhubaneswar Prasad Srivastava, Manoj Kumar and Amit Kumar.

It is next submitted that petitioner was not named in the FIR and during the course of investigation, his name transpired. It is further submitted that similarly situated coaccused, Sanjay Kumar Sinha and Rajiv Kumar, had approached this Court seeking anticipatory bail by filing Cr. Misc No. 57213 of 2024 and the same came to be allowed by an order dated 249-2024. It is next submitted that the case of the petitioner is also similar to the case of Sanjay Kumar Sinha and Rajiv Kumar. It is also submitted that the petitioner will not abscond rather will cooperate in the investigation to prove his innocence as the investigation is still continuing.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.65298 of 2024(3) dt.24-01-2025 3/3 anticipatory bail on furnishing bail bonds of 25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Motihari Town P.S. Case No. 232 of 2017 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
