Petitioner is in custody in connection with Special Case No. 10315 of 2018 arising out of Agamkuan P.S. Case No. 874 of 2018 for the offence under sections 37(c) and 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 272, 273, 414 and 34 of the Indian Penal Code.

Learned counsel for the petitioner would submit that although there is one case but there is no case under the Bihar Prohibition Excise Act.

Considering the fact that petitioner is in custody since 29.10.2018 and four liters of Mahua liquor was allegedly recovered in the instant case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten

Patna High Court Cr.Misc. No.79684 of 2018(2) dt.15-01-2019 2/2 thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise Act), Patna, in connection with Special Case No. 10315 of 2018, arising out of Agamkuan P.S. Case No. 874 of 2018.
