Heard learned counsel for petitioner nos.2 to 6 and learned A.P.P. for the State.

Petitioner nos.2 to 6 apprehend their arrest in connection with Patahi P.S. Case No.85 of 2022 registered under Sections 359, 379,427, 506/34 of the Indian Penal Code and Sections 3 and 4 of the Prevention of Damage to Public

Patna High Court CR. MISC. No.60036 of 2022(4) dt.09-02-2023 2/2 Property Act.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. It is further submitted that the petitioners including co-accused Rambabu Prasad raised voice and filed complaints against the wrongs done by the informant and other officials. Thereafter enquiry was made and recovery was done due to which the informant and other erring officials implicated the petitioners in this case, as is evident from Annexures 2 to 6. Having considered the above facts and circumstances of the case, let the above named petitioner nos.2 to 6 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bonds to the satisfaction of C.J.M.,Motihari, East Champaran in connection with Patahi P.S. Case No.85 of 2022/G.R. No.2132 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
