The petitioners seek bail in a case registered under Sections 457, 380 & 411 of the Indian Penal Code. Allegedly, in absence of the informant, the unknown persons after breaking open the box, committed theft of Rs. 23600/- from the house of the informant.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 30-05-2019. Charge sheet has already been submitted. The petitioners' name

Patna High Court CR. MISC. No.57256 of 2019(2) dt.11-09-2019 2/2 has surfaced in this case on the basis of confessional statement of co-accused Golden Kumar. Rupees 1200/- is said to have been recovered from possession of the petitioners. The same belongs to the petitioners. Due to previous enmity, the petitioners have been made accused in the present case. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S. Case No. 157 of 2019.
