The petitioner seeks bail in Awatar Nagar P.S. Case No. 59 of 2011, corresponding to Sessions Trial No. 26 of 2012, registered for the offences punishable under Section 394 of the Indian Penal Code.
A looted mobile was recovered from the possession of the petitioner. Earlier the prayer for bail of the petitioner was rejected lastly on 28.05.2014 with a direction to the trial court to conclude the trial within six months as the petitioner is in jail for about four years.
It appears from the order of the learned Additional Sessions Judge- VIII, Saran, Chapra that four witnesses have been examined out of which two witnesses have been declared hostile
Patna High Court Cr.Misc. No.5319 of 2015 (2) dt.11-03-2015 2/2 and two witnesses did not identify the petitioner. Considering the facts that the trial has not yet been concluded and the petitioner is in jail since 03.04.2011, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- VIII, Saran, Chapra in connection with Awatar Nagar P.S. Case No. 59 of 2011, corresponding to Sessions Trial No. 26 of 2012.
