JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 789 of 2011, corresponding to Trial No. 1360 of 2019, in which cognizance has been taken under Section 498A of the Indian Penal Code. Petitioners happen to be cousin father-in-law and cousin mother-in-law of the complainant opposite party No.2 and allegation against them is that they fraudulently got changed the pregnancy report of the complainant in order to show that she was pregnant from before.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.60168 of 2019(2) dt.23-09-2019 2/2 that the allegation is false and concocted and other in-laws of the complainant have already been granted bail by the court below itself and they are ready to abide by any condition that may be imposed on them if anticipatory bail is granted to them. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Darbhanga, in connection with Complaint Case No. 789 of 2011, corresponding to Trial No. 1360 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioners have to co-operate in disposal of the trial and appear before court as and when required.
