The petitioner seeks bail in Vibhutipur P.S. Case No. 170 of 2021 corresponding to Sessions Trial No. 216 of 2021, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. As per prosecution case, co-accused Amol Chaudhary caused firearm injury to the brother of informant resulting into his death.

It is submitted that petitioner is not the assailant of deceased and he is only alleged to have accompanied coaccused Amol Chaudhary in committing theft of Sheep. Petitioner has been falsely implicated in this case. Petitioner claims clean antecedent and he is in custody since

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge III, Rosera, Samastipur in connection with Vibhutipur P.S.
