The petitioner apprehends his arrest in Complaint Case No. 739(C) of 2013, registered for the offences punishable under Section 420 and other Sections of the Indian Penal Code and Section 138 of the N.I. Act.

The complainant alleged that the petitioner borrowed Rs. 3,20,000/- for the purpose of business. On demand the petitioner gave him two cheques, but the same were dishonoured when the cheques were presented.

Learned counsel for the petitioner submits that all the allegations are false and concocted. The complainant and petitioner are on business term. The petitioner is ready to settle the account.

Patna High Court Cr.Misc. No.4001 of 2015 (2) dt.29-01-2015 Having considered the facts aforesaid and the fact that during the course of business transaction the dispute arose, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Reshmi Singh, the learned Judicial Magistrate, 1st Class, Hilsa, Nalanda in connection with Complaint Case No. 739(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
