2. The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 149, 341, 448, 323, 325, 307, 354, 504, 506 and 379 of the Indian Penal Code and Section 3 (i) (x) and (xi) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act registered in connection with Nawada SC/ST P.S. Case no.21 of 2014.
3. It is submitted that the petitioners have been falsely implicated and no offence under SC & SC Act is made out, being vague and general in nature as caste name has not been
Patna High Court Cr.Misc. No.37720 of 2014 (2) dt.03-04-2015 2/2 used by the accused. There is no medical report in support of the accusations with regard to the injuries said to have been inflicted by the petitioners side nor any ingredient of the offence under Section 354 of the IPC is made out.
4. Learned APP, who is assisted by the learned counsel for the informant, opposed the prayer for anticipatory bail.
5. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioners' arrest or surrender before the court below within six weeks from the date of communication of this order, let the petitioners, namely, Gunjan Singh alias Ashish Ranjan, Ranjan Singh @ Raman Kumar Singh @ Amit Ranjan, Pankaj Singh @ Pankaj Kumar, Babulal Singh, Shesh Kumar Singh @ Shesh Kumar and Tuntun Singh, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada SC/ST P.S. Case No. 21 of 2014, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Vikash Jain, J) B.T/- U T
