JUSTICE AMARESH KUMAR LAL ORAL ORDER 05-02-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 323, 307, 498 A of the Indian Penal Code and 3⁄4 D.P.Act.

The allegation against the petitioner is to have demanded Rs. one lakh as dowry but due to non fulfillment of demand of dowry, informant was tortured and when she wanted to go to Chandigarh to her parents and had boarded in a tempo. She was dragged out and was assaulted with fists and slaps. After investigation, charge sheet has been submitted under Section 498 A, 323 and 494 Indian Penal Code and 3⁄4 of Dowry prohibition It is submitted that the petitioner has no criminal antecedent and he has been in custody since 26.07. 2014. No.4839 of 2015 (2) dt.05-02-2015 2/2 named petitioner, Sanjay Rai @ Sanjay Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sitamarhi in connection with Majorganj P.S.Case No. 250/2014 with the following conditions :- I) One of the bailors will be the close relative of the petitioner.

II) The petitioner will not indulge in similar or in any other offence.

III) The petitioner will be well represented in the Court.

IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
