JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kajra P.S. Case No. 130 of 2016 for the offence under Sections 468, 406, 409, 420 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner superannuated ten years back. He further submits that in the instant case the main accused, who made excess payment, has already been granted bail vide order 12.12.2017 in Cr. Misc. No. 58717 of 2017. The petitioner is in custody since 06.11.2018.

Considering the fact that the petitioner superannuated ten years back and with regard to excess payment, the main accused has been granted bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of

Patna High Court Cr.Misc. No.80322 of 2018(2) dt.30-01-2019 2/2 Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Kajra P.S. Case No. 130 of 2016.
