13-07-2017 Heard Sri Raj Kumar, learned counsel for the petitioner and Sri Akshay Lal Pandit, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Ziradei P.S. Case No. 11 of 2017 registered for offence under Sections 272, 273, 308 of the Indian Penal Code and Sections 30/38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of anticipatory bail, primarily on the ground that petitioner was falsely implicated due to some animosity.
Learned counsel for the petitioner submits that his brother was using the motorcycle of the petitioner and he was made accused and his motorcycle was shown to be recovered. He submits that save and except suspicion, there is no direct
Patna High Court Cr.Misc. No.22495 of 2017 (3) dt.13-07-2017 2/2 accusation against the petitioner.
Learned Addl. Public Prosecutor accepts that save & except recovery of motorcycle of the petitioner, there is no direct accusation against the petitioner.
Considering the nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Rajesh Singh @ Rajesh Kumar Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Siwan in connection with Ziradei P.S.
