Petitioner, who is in custody, seeks bail in connection with Ara Town P.S. Case No. 515 of 2018 registered for the offences punishable under Section 307/34 of the Indian Penal Code and Section 25(1-b)a, 26, 27, 35 of Arms Act.
Informant has alleged that on 03.09.2018 while he was at the shop of Prakash Chaudhari from where petitioner and other co-accused took him near Jamira Road, Dharahar Mathiya and petitioner fired upon him which it his left thigh. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. There is general and omnibus allegation against the petitioner. Petitioner is in custody since 05.09.2018.
Patna High Court CR. MISC. No.80055 of 2018(4) dt.27-02-2019 2/2 Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.
However, after completing one year of the custody, the petitioner would be at liberty to renew his prayer for grant of bail.
