2. The petitioner seeks anticipatory bail in connection with Saraiya P.S. Case No. 423 of 2023, registered for the offence punishable under Sections 272, 273, 420, 120(b)/34 of the Indian Penal Code and under Sections 30(a), 32(2), 32(3), 36, 41(1), 41(2) of the Bihar Prohibition and Excise Act.

3. As per F.I.R., total 4200.00 litres of illicit beer was recovered from the tanker. Apprehended person disclosed the name of the petitioner that the seized beer belongs to the petitioner.

4. Learned counsel for the petitioner has falsely been implicated in the present case. He further submits that petitioner has five criminal antecedents of similar nature.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid submission of the parties and also the petitioner has five criminal antecedents of similar nature, I am not inclined to grant anticipatory bail to the petitioner.

7. Hence, his prayer for anticipatory bail stands rejected.
