JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 29-06-2015 Heard the Counsel for the petitioner and Mr. Madhuranand Prasad, APP for the State. In spite of notice, O.P. No. 2 has not appeared. Mr. Shashi Bhushan Kumar, learned Advocate who had earlier appeared in this Court states that he has already issued no objection certificate as requested by his client (O.P. No. 2). Petitioner being husband of the complainant seeks anticipatory bail in Complaint Case No. 25 of 2013 registered under Sections 380, 498A IPC and other allied sections of Penal Code. The wedlock has produced siblings. The petitioner has taken a stand before this Court that he is always ready and willing to resolve the dispute and allow the complainant to live with him and to give her full protection. He is ready to support his child.

No.38506 of 2014 (3) dt.29-06-2015 2/2 Considering the aforesaid, I direct that in the event of arrest or surrender in the Court below within four weeks, the petitioner abovenamed is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri (Rohtas) in Complaint Case No. 25 of 2013 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further condition that one of the bailers shall be the own/close family members of the petitioner. Along with the bail bonds, the petitioner shall produce a demand draft in the sum of Rs. 4,000/- favouring the complainant for the upkeep of his daughter and/or deposit the aforesaid amount in the Nazarat and produce a receipt thereof.
