Versus
The State of Bihar.
.... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Nawal Kishore Prasad For the Opposite Party/s : Mr. Sri Amrendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 19-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 324, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act. For land dispute, the petitioner allegedly fired causing injury at the leg of the informant.
Submission of the petitioner is that the allegation is not specific and for land dispute the petitioner has been falsely implicated. The doctor has found simple injury. Learned counsel for the informant opposed the prayer for bail.
Considering the nature of allegation, in my view,
Patna High Court Cr.Misc. No.4053 of 2017 (4) dt.19-06-2017 this is not a fit case for anticipatory bail. Hence, the prayer of the petitioner for grant of anticipatory bail in connection with Naubatpur P.S. Case No.215 of 2016 pending in the court of learned J.M.-1st Class, Danapur (Patna) is rejected.
