JUSTICE RAJESH KUMAR VERMA ORAL ORDER 09-04-2026 Heard Mrs. Kumari Sujata Sinha, learned counsel for the petitioner, Mr. Adarsh Singh, learned counsel for the Informant and Mr. Bhanu Pratap Singh, learned APP for the State.
2. Petitioner seeks bail, who is in custody since 06.03.2025, in connection with Gandhi Maidan P.S. Case No. 311 of 2024, F.I.R. dated 11.06.2024 registered for the offences punishable under Sections 420, 406, 34 of the Indian Penal Code.
3. Allegation against the petitioner is that he has cheated the informant and took away his Rs. 1,75,000/- (One Lakh Seventy Five Thousand) in the name of selling Scorpio to him.
4. Learned counsel for the petitioner submits that the petitioner carries nine more cases other than the present one in which he is on bail in seven cases. She further submits that the
Patna High Court CR. MISC. No.61916 of 2025(8) dt.09-04-2026 2/3 allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offene as alleged in the F.I.R. Learned counsel for the petitioner on instruction submits that the petitioner is ready to return the amount of Rs. 1,75,000/- which he has received from the informant.
5. Learned counsel for the Informant has no objection if the petitioner is ready to return the amount in question.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna in connection with Gandhi Maidan P.S. Case No. 311 of 2024, subject to the following conditions :-
(1) The petitioner shall deposit Rs. 50,000/- (Fifty Thousand) by way of demand draft in favour of the informant/complainant at the time of furnishing bail bond and the learned Court below is directed to hand over the said demand draft to the informant/complainant or his representative and rest amount of Rs. 1,25,000/- ( One Lakh Twenty Five Thousand) shall be paid within a period of two months and if the petitioner fails to pay the remaining amount i.e. Rs. 1,25,000/- ( One Lakh Twenty Five Thousand) to the informant/complainant, the informant/complainant shall be at liberty to move before the
Patna High Court CR. MISC. No.61916 of 2025(8) dt.09-04-2026 3/3 appropriate forum for cancellation of his bail bond.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.
(3) If the petitioner tampers with the evidence or the witness, in that case, the prosecution will be at liberty to move for cancellation of bail.
(4) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedents, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
