The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and it is alleged that police while patrolling was informed about theft of iron rods by 4-5 miscreants, accordingly the police reached at the place of occurrence and on seeing the police, the miscreants started fleeing but one of the miscreants was caught who disclosed the name of the petitioner.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is

No.72034 of 2021(2) dt.02-08-2022 2/2 next submitted that confession made before police has no evidentiary value, it is further submitted that petitioner is a person with clean antecedent and was not arrested from the spot. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Akbarpur P.S. Case No. 306 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. with a condition that one of the bailors of the petitioner shall be his wife, Kanchan Devi.
