It appears on perusal of the impugned judgment that in the learned court below the opposite party-petitioner was examined and he himself deposed that he is ready to pay Rs. 2000/- per month as maintenance to his mother. Taking note of the statement of the petitioner the learned court below has allowed the application under Section 125 Cr.P.C. and directed the petitioner to pay Rs. 2000/- per month to the applicantmother. On perusal of the revision application, this Court finds no statement at all that any error has been committed by the learned court below in recording the statement of this petitioner wherein he has himself expressed his readiness to pay Rs.

Patna High Court CR. REV. No.1145 of 2019(7) dt.27-09-2022 2/2 2000/- per month maintenance to his mother.

In the opinion of this Court, this Revision Application is completely misconceived and is nothing but a misuse of the process of court. It is, thus, dismissed.

If the petitioner is not paying the said maintenance amount to his mother the entire arrears as well as current maintenance shall be realized from him with additional sum of Rs. 25000/- which this Court imposes as cost upon him for keeping his mother engaged in litigation since the year 2017. Let the entire amount be recovered through the process of court.
