JUSTICE AMARESH KUMAR LAL ORAL ORDER 09-02-2015 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

The allegation against the accused including the petitioners (brothers of the deceased) is that that they administered poison to the husband of the informant, causing his death. It is submitted that the informant is not the eye witness to the occurrence and only suspicion has been made against the petitioners and other accused. The deceased died due to illness and in the similar facts and circumstances, parents and sister of the deceased have been granted anticipatory bail vide order dated 16th January, 2015 passed in Cr. Misc. No. 1143 of 2015 and the petitioners have no criminal antecedent.

No.5329 of 2015 (2) dt.09-02-2015 2/2 Considering the facts and circumstances, the above named petitioners Manoj Thakur and Mantu Thakur are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S.Case No. 71/2013 with following conditions :- I) One of the bailors will be the close relative of the petitioners.

II) The petitioners will not indulge in similar or in any other offence.

III) The petitioners will be well represented in the Court.

IV) In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the Court concerned.
