JUSTICE S. KUMAR ORAL ORDER 30-05-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in POCSO Case no. 17 of 2017 arising out of Rampur P. S. Case no. 46 of 2017 for the offences registered under Sections 354 B of the Indian Penal Code and Section 8 of the Prevention of Children from Sexual Offences Act, 2012.
It is alleged that petitioner made an attempt to outrage modesty of the daughter of the informant. It has been contended on behalf of the petitioner that he has falsely been implicated in the present case. Daughter of the informant used to take tuition from the son of the petitioner and a dispute arose between son of the petitioner and informant with regard to the tuition fee. As a matter of fact, petitioner tried to

It has further been stated that the girl in her statement recorded under Section 164 of the Code of Criminal Procedure has not stated any obscene act against the petitioner. A compromise petition has already been filed by the informant stating that due to some confusion the present case has been lodged against the petitioner. Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl.
