2. In the present case, the petitioner seeks bail in connection with Kishanganj P.S. Case No. 258 of 2025 registered for the alleged offences under Sections 310(2), 311 of B.N.S.
3. As per prosecution case, an attempt was made to loot the money being carried by the informant by six miscreants riding two motorcycles. The robbers were unsuccessful in snatching the bag containing Rs.1,46,000/- from the informant which the informant threw down from a bridge. The robbers took away mobile phone of the informant. The name of the petitioner transpired during investigation as one of the robbers

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of the petitioner. The name of the petitioner sprang up in this case on the basis of confessional statement of co-accused Rashid Anwar and except for the confessional statement there is no material to show his involved the alleged occurrence. No Test Identification Parade has been carried out. The petitioner is in custody 22.05.2025 and charge sheet has been submitted. The petitioner is having antecedent of one case.
5. Learned APP opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that no recovery has been shown from this petitioner and further considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj/concerned Court in connection with Kishanganj P.S.
Patna High Court CR. MISC. No.60751 of 2025(2) dt.10-09-2025 3/3 Case No. 258 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
