The petitioner is in custody in a case registered for offence punishable under Section 395 of the Indian Penal Code. It is a case of commission of dacoity and assault by the unknown persons. The accused persons looted the gold and silver jewellery and Rs.21,000/- in cash.

It is submitted by the learned counsel for the petitioner that the petitioner has falsely been implicated in this case. The petitioner has not been put on test identification parade and the stolen articles have not been recovered from the possession of the petitioner. It is also submitted that other accused, on similar footing, has been granted bail. The petitioner is in custody since 03.03.2022.

Considering the aforesaid submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bathanaha P.S. Case No. 349 of 2021 to the satisfaction of the Chief Judicial Magistrate, Sitamarhi.
