1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Sugauli P.S. Case No. 441 of 2022 registered under Sections 363, 366-A, 34 of the Indian Penal Code and Section 8 of the POCSO Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. Further he submits that the victim in her statement recorded under Section 164 Cr. P.C. specifically stated that no one had kidnapped her rather she went to the house of her Mausi without giving information to her family members. Further he contended that petitioner has no criminal antecedent.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the concerned Court within a period of four weeks from today, on furnishing bail personal bond to the satisfaction of the 6th Additional Sessions Judge-cum-Special Judge, POCSO Act, East Champaran at Motihari in connection with Sugauli P.S. Case No. 441 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
