The petitioner is apprehending his arrest in connection with Harsidhi P.S.Case no.292 of 2017 , registered for offences punishable under Sections 304, 316/34 of the Indian Penal Code.
Allegation as per FIR is that the wife of the informant was suffering from labour pain,she was taken to the hospital and one Dr. Chandan asked them to come to his hospital and there she was treated and died and later on name of the petitioner also transpired.
Submission of the learned counsel for the petitioner is that he is not named in the FIR and later on his name transpired during the course of the investigation on the supervision note of the Dy. S.P. and in that it has been stated
Patna High Court Cr.Misc. No.1309 of 2019(2) dt.18-01-2019 2/2 that she was taken to the hospital of Dr. Chandan. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari in connection with Harsidhi P.S.Case no.292 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case.. With the aforesaid observation, this application is allowed.
