Petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code and under Section 27 of the Arms Act. The F.I.R. of the occurrence of murder was lodged against unknown. However, during investigation it revealed that the petitioner and the others had taken the deceased from his house. The prayer for bail has been refused by the court below considering the gravity of the offence. The gravity and material against the accused both are important factors to consider for bail.

Nagar, P.S. Case No. 33 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
