The petitioner seeks regular bail in Rafiganj P.S. Case No. 169 of 2014, registered for the offences punishable under Section 364A/120B of the Indian Penal Code. The learned counsel for the petitioner submits that petitioner is not named in the First Information Report. The informant lodged a case on the basis of the information received from his own wife Rekha Devi. During the course of investigation, it came that Rakha Devi hatched-up a conspiracy with her paramour and she handed over the child to Birendra Yadav, Babunand Yadav (petitioner), Rakesh Yadav and Satyendra Yadav. She disclosed that petitioner also conspired in kidnapping of the boy. It appears from the record that the mother of the childvictim herself handed over the boy to her paramour Birendra

Patna High Court Cr.Misc. No.3518 of 2015 (2) dt.28-01-2015 Yadav and on her request Birendra Yadav made call to the husband of Rekha Devi for demand of ransom. The boy was recovered. The name of the petitioner figured in the confessional statement of Rekha Devi.

Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 169 of 2014.
