JUSTICE RAKESH KUMAR ORAL ORDER 11-04-2016 Heard Sri Ram Suresh Roy, learned Senior Counsel, who was assisted by Sri Abhay Kumar Roy, learned counsel for the petitioner and Sri Sunil Kumar Pandey, learned Addl. Public Prosecutor.

The petitioner, who is in custody since 06.11.2015 in connection with Banka P.S. Case no.611/15 registered for the offence under Sections 302, 201/ 34 of the Indian Penal, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the F.I.R. was lodged against unknown. However, during investigation only fact has emerged that on the basis of call details of Mobile the deceased was in touch with the petitioner. The Mobile was, though, in the name of the petitioner, the said Mobile

Patna High Court Cr.Misc. No.7079 of 2016 (3) dt.11-04-2016 2/2 was being used by the son of the petitioner. He submits that even for the time being,if it is accepted that the deceased was supposed to be in touch with the deceased on the said Mobile, there is no cogent material against the petitioner to show involvement in the murder of the deceased.

Be that as it may, in view of facts and circumstances, let the petitioner, namely, Dinesh Das be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case no.611/2015 with a condition that the petitioner shall render full co-operation to the Investigating Officer during further investigation.
