2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 307, 379 and 34 of the Indian Penal Code .

3. As per the prosecution case, this petitioner assaulted on the head of the brother of the informant by means of spade in which he sustained injury .

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case . In fact the real fact behind the dispute is that brother of the informant along with his goons armed with pistol, iron rod etc entered into shop of the petitioner and snatched Rs. 60,000/- from the boy. They even assaulted the petitioner and his brother

5. Learned counsel for the State opposes the prayer for bail and submits that the injury caused by this petitioner is grievous in nature .

6. Considering the nature of injury caused by this petitioner, and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected.
