The petitioner apprehends his arrest in connection with Kazi Mohammadpur P.S. Case No. 215 of 2016, registered for the offence punishable under Section 379 of the Indian Penal Code.

Allegedly, unknown thief committed theft of mobile of the informant having two SIMs and during investigation, the said stolen mobile of the informant was recovered from the bed of the petitioner.

Submission is of false implication and that the wife of the petitioner has purchased second hand mobile without

Patna High Court Cr.Misc. No.22651 of 2017 (3) dt.06-07-2017 2/2 knowing the same that it was of theft property and, as such, the petitioner deserves sympathetic consideration, to which the learned A.P.P. seriously opposes.

In the facts and circumstances as stated above, considering the alleged recovery, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected in connection with Kazi Mohammadpur P.S.
