JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Heard learned counsels for the petitioners, informant and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Mehus P.S. Case No. 24 of 2015 for the offences instituted under Sections 420, 467, 471, 406, 506, 509 and 511 of the IPC.

The prosecution story, in brief, is that one Sudha Devi purchased the land of area about 67 1⁄4 decimals land of different plots of Mouza-Mehus from one Most. Mundrika Devi through registered sale deed on 16.08.2012 and she came in peaceful possession from the date of purchase and the same land was sold

Patna High Court Cr.Misc. No.8471 of 2016 (2) dt.09-03-2016 2/3 by Ram Naresh Singh and he executed the sale deed on 24.11.2015 in favour of petitioner no.1 Lalit Vijay. It is further alleged that petitioner no.2 Chitranjan Kumar knowing the fact put signature on the said fake and forged deed as witness and when the informant knew the said fact she got certified copy of the sale deed and made complaint before the petitioners for their illegal act then all the petitioners abused and assaulted her and made an attempt to outrage the modesty. Anyhow, she saved her dignity after escaping. It is further alleged that she has been threatened that none would be allowed to go on land otherwise she and her family would be killed.

It has been submitted on behalf of the petitioners that the petitioner nos. 1, 2 and 3 have got no criminal antecedent. The petitioner no. 4 is an accused in one another case in which he is on bail. The petitioners have falsely been implicated in the present case. For the same piece of land there is title suit pending between Ram Naresh Singh and Most. Mundrika Devi. The informant is said to have purchased the said land from Most. Mundrika Devi. The petitioners are said to have purchased the said land from Ram Naresh Singh. The matter relates to civil dispute. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Mehus P.S. Case No. 24/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Sheikhpura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
