The petitioner apprehends his arrest in Magadh Medical P.S. Case No. 236/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code.
The petitioner is alleged to have assaulted the informant with lathi on his nose. Karu Singh is also alleged to have assaulted the informant with iron hammer on his head. Learned counsel for the petitioner submits that the injuries found on the person of the informant Subodh Kumar is simple in nature.
Learned counsel for the informant as well as the
Patna High Court Cr.Misc. No.23775 of 2017 (2) dt.14-07-2017 2/2 learned A.P.P. opposed the prayer for anticipatory bail of the petitioner.
From perusal of the order of the learned Sessions Judge, it appears that injuries found on the person of the informant is grievous in nature and he remained in hospital for treatment for a long time. Karu Sing and the petitioner is the assailant of the informant.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
