The petitioner is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Section 376 of the Indian Penal Code.

It is alleged that the petitioner established forceful physical relationship with the complainant.

It is submitted by learned counsel for the petitioner that for occurrence between 07.11.2007 to 04.04.2008, complaint was filed on 01.07.2009 when cognizance has been taken on 22.06.2011. Moreover, the complainant is in habit of lodging frivolous case to make extortion.
