Petitioner happens to be husband of the complainant and his marriage was solemnized with the complainant in the year 2001 whereas present case was filed after 12 years of the marriage. Moreover, much prior to filing of complaint case, petitioner filed divorce suit being Matrimonial suit no. 43/2013 in the Family court, Purnea.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Prashant Kumar, Judicial Magistrate, Ist Class, Purnea/concerned court in Complaint Case no. 2937/2013.
