JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 29.01.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Saharsa Rail P. S. case no. 6/2014 registered under sections 147,148, 353, 427, 436 of the IPC and sections 146, 147, 151, 174 of the Indian Railway Act.

Petitioners are not named in the first information report but during the course of investigation, names of these petitioners surfaced in this case.

The contention on behalf of the petitioners is that on the same day, Saharsa Sadar P. S. case no. 451/2014 was registered and in the said case, petitioners were shown accused but when they got bail in the aforesaid case, police dragged them in the present case. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed

Patna High Court Cr.Misc. No.3922 of 2015 (2) dt.29-01-2015 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Khagaria in Saharsa Rail P. S. case no. 6/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
