JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 This is an application for grant of anticipatory bail in connection with Bhagwanpur P.S. Case No. 181 of 2018, disclosing offences under Sections 304/34 of the Indian Penal Code.

Allegation as per F.I.R. is that the deceased was selling vegetables and due to heavy rain, the vegetables started flowing and in order to save the vegetables, the deceased went there and received electric shock and there is allegation that the petitioners were running generators, due to which the deceased received electrical shock.

Submission of learned counsel for the petitioners is that the supervision note shows that the deceased had received electric shock through the solar light and at that time generators

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Bhagwanpur P.S. Case No. 181 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
