"That in this writ application is being filed for giving the order/orders, direction/s commanding the Respondents especially Respondent no. 4. The District Magistrate Cum District Election Officer, (Panchayat), Kishanganj to take legal action against the respondent no. 7 namely Shakil Alam Ansari who has deliberately and dishonestly given two different dates of birth in Bhagal Panchayat Election which have been held in the year 2016 and 2022 for the
Patna High Court CWJC No.14774 of 2024(2) dt.07-10-2024 2/2 selection of ward member and further for giving order/s, direction/s to implement the order vide letter no. 30-95/2023 dated 23.11.2023 issued by the Respondent no. 3 namely the officer on special duty, State Election Commission, Patna who has directed the District Magistrate Cum District Election Officer (panchayat) Kishanganj to enquire into the case the complaint and submit report to the commission as soon as possible."
2. Learned counsel for the petitioner has raised certain question which has to be addressed by the respondents.
3. Learned counsel for State Election Commission submits that if a proper application is filed, steps shall be taken immediately.
4. Learned counsel for the petitioner submits that he will be filing an application within a period of four weeks.
5. In such case, the State Election Commission shall take up the matter and dispose it of in accordance with law after hearing all the necessary parties.
6. The writ petition stands disposed of.
