2. In the present case, the petitioner seeks bail in connection with Araria Town P.S. Case No. 230 of 2025 registered on 09.06.2025 for the offences under Sections 8(c) and 21(B) of the NDPS Act.
3. As per prosecution case, on the basis of a video in which the petitioner and others were found dealing with smack, a raid was conducted on the house of co-accused brother of this petitioner and two co-accused persons were apprehended. From the search of the house, recovery of 101 gram of smack was made apart from Rs. 4500/- in cash and a motorcycle.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.64997 of 2025(2) dt.17-09-2025 2/3 petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The house from which recovery has been made does not belong to this petitioner and the said house belongs to the brother of the petitioner. Nothing incriminating has been recovered from the person or possession of this petitioner. Petitioner has no concern with the seized article as is apparent from the FIR. There is no eye-witness to confirm the fact that the petitioner was even present at the place of occurrence. Petitioner is having antecedent of 4 cases and she is on bail in all these cases. Petitioner is in custody since 10.06.2025 and charge-sheet has been submitted.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that less than commercial quantity of contraband has been recovered and also considering the period of custody of the petitioner and submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Araria/ concerned court
Patna High Court CR. MISC. No.64997 of 2025(2) dt.17-09-2025 3/3 in connection with Araria Town P.S. Case No. 230 of 2025, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
